IMPORTANT: New EU-wide regulation for ready-to-use chlorine dioxide solutions

Currently, it can be observed that an increasing number of competition law warnings (Abmahnungen) are being issued against providers of ready-to-use chlorine dioxide solutions, in which the marketability or permissibility of the products is being called into question. Many products and brands that have until now been widely available on the German market could therefore in future only be offered in a restricted form or, in some cases, no longer at all.

On this page, we would like to inform all our end customers and resellers of ready-to-use chlorine dioxide solutions about the new EU legal regulations and their effects on the European market.

The following explanations do not apply to two-component products such as our MMS CLASSIC or CDSplus®, but exclusively to ready-to-use chlorine dioxide solutions (ex situ) such as our CDSpure®!

What has changed in legal terms?

The EU has now regulated ready-to-use chlorine dioxide solutions, alongside several other chemicals. After more than 9 years of approval procedures and many millions of euros in study and consulting costs, from now on only a few registered dossier holders are permitted to manufacture ready-to-use chlorine dioxide solutions and place them on the market within the EU. All transitional regulations and the unregulated gray market have thus come to an end. This has the following consequences:

  • In-house production of ready-to-use chlorine dioxide solutions and placing them on the market within the EU is now a criminal offense!
  • Importing from non-EU countries such as China is prohibited.
  • Sourcing ready-to-use chlorine dioxide solutions in bulk containers and decanting them into smaller bottles is now reserved exclusively for dossier holders (product manufacturing).
  • The sale of non-marketable remaining stock by resellers and marketplaces is likewise prohibited.
  • Violations may result in criminal complaints and claims for damages.
  • All previous product registrations with the BAuA based on incorrect in-situ procedures are void.
  • Resellers must now obtain their ready-to-use solution exclusively from an Article 95 dossier holder.

The good news

We have followed these long-running regulatory processes very closely and acted in good time. Thanks to our 17 years of collaboration with a dossier holder, we have now been granted an exclusive EU distribution agreement.

CONCLUSION: Ready-to-use chlorine dioxide solutions (CDS/CDL) remain available in the EU. The range of products will become clearer. All ready-to-use chlorine dioxide solutions must now comply with the Article 95 list of the ECHA (European Chemicals Agency).

Our tip: Since many manufacturers are now dropping out, demand at our dossier holder is rising sharply. Production capacities are being increased as quickly as possible. Nevertheless, over the next 6-9 months there may be supply bottlenecks and limited delivery allocations. It therefore makes sense for resellers and end customers to act in good time now!
